Terms and Conditions

These Terms & Conditions ("Terms") govern your use of Shawnigan Nordic Spa (the "Spa"), including our facilities, pools, saunas, steam rooms, treatment areas, relaxation areas, retail services, memberships, gift cards, and other services. By making a reservation, purchasing a service, entering the Spa premises, or using any Spa facility, you acknowledge that you have read, understood, and agree to these Terms.

1.Reservations

Reservations are mandatory and may be required for certain Spa experiences, treatments, packages, or periods of high demand. Guests are responsible for providing accurate contact and booking information at the time of reservation. Reservations are subject to availability and are not confirmed until the Spa has issued a booking confirmation. The Spa reserves the right to limit the number of guests admitted at any given time in order to maintain a safe and comfortable environment. Guests should arrive at least 10 minutes before their scheduled reservation time to allow sufficient time for check-in. Late arrival may result in a shortened experience. The Spa is not obligated to extend the reservation or treatment time because of a guest's late arrival.

2.Cancellations and No-Shows

Unless otherwise stated for a particular service, reservation cancellations or changes must be made at least 24 hours before the scheduled reservation. Guests who fail to attend a reservation without cancelling ("no-show") may be charged up to 100% of the reservation value. Certain promotional rates, special events, group bookings, packages, treatments, or holiday-period reservations may have different cancellation policies. The applicable policy will be disclosed at the time of booking. The Spa may waive a cancellation fee at its discretion in exceptional circumstances.

3.Spa Admission

Admission to the Spa is subject to availability, capacity limits, applicable age requirements, and compliance with these Terms. The Spa reserves the right to refuse admission or remove a guest from the premises where reasonably necessary for safety, security, operational, or conduct-related reasons. Admission does not guarantee access to a particular sauna tub, lounge, or other facility if that facility is temporarily unavailable, at capacity, undergoing maintenance, or closed for safety reasons.

4.Health and Safety

Guests use the Spa facilities voluntarily and are responsible for determining whether participation is appropriate for them. Spa facilities may involve exposure to high temperatures, hot water, cold water, steam, slippery surfaces, changes in temperature, physical exertion, and other conditions that may present risks to certain individuals. Guests should consult a physician or other qualified healthcare professional before using the Spa if they have any medical condition, injury, pregnancy-related concern, cardiovascular condition, blood-pressure concern, respiratory condition, mobility limitation, or other condition that could be affected by heat, cold, water immersion, or physical exertion. Guests must immediately leave a pool, sauna, steam room, cold plunge, or other facility if they feel faint, dizzy, nauseous, short of breath, unwell, or otherwise uncomfortable. Guests must notify Spa staff immediately in the event of an injury, illness, accident, or unsafe condition. The Spa is not a medical facility and its services are not intended to diagnose, treat, or cure medical conditions.

5.Hydrotherapy Facilities

Hydrotherapy facilities, including cold plunges, saunas, and related amenities, must be used in accordance with posted instructions and staff directions. Guests must: - Follow all posted safety instructions. - Observe designated time limits where applicable. - Use handrails and other safety equipment where provided. - Walk rather than run. - Enter and exit pools carefully. - Shower before entering pools where required. - Refrain from using facilities while impaired by alcohol, cannabis, recreational drugs, or medication that may impair judgment or coordination. - Immediately report equipment problems or unsafe conditions to Spa staff. Guests should take reasonable breaks between hot and cold experiences and remain adequately hydrated. The Spa may restrict or suspend access to any hydrotherapy facility when necessary for safety or operational reasons.

6.Prohibited Conduct

For the safety, comfort, and privacy of all guests, the following are prohibited: - Running, pushing, fighting, or other unsafe behaviour. - Harassment, intimidation, threats, or abusive conduct. - Sexual activity or sexually inappropriate conduct. - Discriminatory or hateful conduct. - Excessive noise or disruptive behaviour. - Consumption or possession of illegal substances. - Bringing weapons or dangerous objects onto the premises. - Tampering with Spa equipment. - Unauthorized photography, video, or audio recording. - Any conduct that interferes with another guest's enjoyment or privacy. - Failure to follow reasonable instructions from Spa staff. The Spa may immediately terminate a guest's visit and require the guest to leave the premises for prohibited or inappropriate conduct. Refunds will not necessarily be provided in such circumstances.

7.Alcohol and Intoxicating Substances

Alcohol may only be consumed in areas where it is expressly permitted by the Spa and applicable law. Guests must not enter or use Spa facilities while intoxicated or impaired. The Spa may refuse service or remove a guest from the premises where staff reasonably believe that the guest is intoxicated or impaired. Guests must never use hydrotherapy facilities while impaired.

8.Minors

The minimum age for admission to the Spa is 19, unless otherwise specified. Guests under the age of 19 must be accompanied and supervised by an adult in accordance with Spa policies. Parents or guardians are responsible for ensuring that minors under their supervision comply with all Spa rules and safety requirements.

9.Personal Belongings

Guests are responsible for their personal belongings. The Spa recommends that valuable items not be brought onto the premises. To the extent permitted by law, the Spa is not responsible for loss, theft, or damage to personal property except where such responsibility cannot legally be excluded or limited.

10.Clothing and Personal Hygiene

Guests must comply with the Spa's clothing and hygiene requirements. Appropriate swimwear must be worn in designated aquatic areas unless otherwise indicated by Spa policy. Guests must shower before entering pools where required. Guests must not use Spa facilities if they have a contagious illness, open wound, or other condition that could reasonably pose a health risk to other guests.

11.Privacy and Photography

The Spa is intended to provide a quiet and private environment. Photography, video recording, and audio recording may be restricted or prohibited in certain areas. The Spa may operate security cameras in appropriate areas for safety and security purposes. Cameras will not be placed in areas where guests would reasonably expect complete privacy, such as changing rooms, washrooms, treatment rooms, or similar areas.

12.Lost and Found

Items found on the Spa premises will be retained for 30 days, after which unclaimed items may be donated, recycled, disposed of, or otherwise handled at the Spa's discretion. Guests should contact the Spa as soon as possible regarding lost property.

13.Pricing and Payments

Prices are stated in Canadian dollars unless otherwise indicated. Applicable taxes and fees may be added to advertised prices. The Spa accepts the payment methods displayed at the time of purchase. The Spa reserves the right to correct pricing errors and to cancel or modify transactions affected by an obvious pricing or administrative error, subject to applicable law.

14.Promotions and Special Offers

Promotions, discounts, packages, and special offers are subject to their stated terms. Unless expressly stated otherwise, promotions cannot be combined with other offers. The Spa reserves the right to modify or withdraw promotional offers where permitted by law.

15.Facility Closures

The Spa may temporarily close or restrict access to facilities due to maintenance, cleaning, repairs, weather, emergencies, staffing requirements, health or safety concerns, or circumstances beyond the Spa's reasonable control. The Spa will make reasonable efforts to provide notice where practicable. Where an entire reservation cannot reasonably be provided because of a Spa-initiated closure, the Spa may offer an alternative date, credit, replacement service, or refund as appropriate.

16.Weather and Unforeseen Circumstances

The Spa operates in a variety of weather conditions and may remain open during inclement weather. If severe weather, natural disaster, utility failure, government order, emergency, or another circumstance beyond the Spa's reasonable control prevents the Spa from operating safely, the Spa may close or modify operations. Reservation remedies in such circumstances will be determined based on the circumstances and applicable law.

17.Assumption of Risk and Release

Guests acknowledge that participation in Spa activities may involve inherent risks, including but not limited to slips and falls, burns, overheating, dehydration, cold exposure, changes in blood pressure, fainting, allergic reactions, water-related incidents, and other injuries or illnesses. Guests voluntarily assume the inherent risks associated with using the Spa facilities and participating in Spa activities. To the fullest extent permitted by applicable law, guests agree that the Spa, its owners, operators, employees, contractors, and service providers will not be responsible for injury, loss, or damage arising from a guest's use of the Spa facilities except to the extent caused by circumstances for which liability cannot legally be excluded or limited. Nothing in these Terms is intended to exclude, restrict, or limit any liability, right, or remedy that cannot lawfully be excluded, restricted, or limited under applicable law.

18.Indemnification

To the fullest extent permitted by law, guests agree to be responsible for losses, claims, damages, or expenses arising from their intentional or negligent conduct, violation of these Terms, or damage they cause to Spa property or to another person's property. Nothing in this section limits any rights or remedies that cannot legally be limited.

19.Damage to Property

Guests may be charged for reasonable costs associated with repairing or replacing Spa property damaged intentionally or through negligent or reckless conduct. This includes damage to fixtures, equipment, furnishings, lockers, robes, towels, or other Spa property.

20.Accessibility

The Spa strives to provide an accessible and inclusive environment. Guests requiring accessibility accommodations are encouraged to contact the Spa before their visit so that reasonable accommodations can be discussed and arranged where possible. Some Spa facilities may have physical, architectural, or operational limitations. Staff will make reasonable efforts to identify suitable alternatives where available.

21.Service Standards and Guest Concerns

The Spa aims to provide a safe, respectful, clean, and welcoming environment. Guests who have concerns regarding a service, treatment, facility, or staff interaction should notify management as soon as reasonably possible so that the Spa has an opportunity to address the concern.

22.Changes to These Terms

The Spa may update these Terms from time to time. The current version will be made available on the Spa's website and/or at the Spa. Changes will not retroactively alter rights or obligations where prohibited by law.

23.Governing Law

These Terms are governed by the laws of the Province of British Columbia and the applicable laws of Canada. Any dispute will be subject to the applicable courts and dispute-resolution processes having jurisdiction in British Columbia, subject to applicable law.

24.Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be interpreted or modified to the minimum extent necessary to make it enforceable where legally permitted. The remaining provisions will continue in full force and effect.

25.Entire Agreement

These Terms, together with any applicable booking terms, membership agreement, promotional terms, posted facility rules, and other policies expressly incorporated into them, constitute the agreement between the guest and the Spa concerning use of the Spa.
